Every reasonable care and attention has been taken to ensure that all the descriptions and colours of our Products that appear on PENELOPE CHILVERS are accurate. We cannot guarantee that your computer’s display of the colours accurately reflects the colour of the Products. Your Products may vary slightly from those images. All Products shown on the Site are subject to availability. 


Consumer Contracts Regulation (Uk Deliveries Only)


You have an automatic cooling-off period in which you can cancel an order. This starts as soon as you place the order and ends 14 days from the day you receive the item/s. You must inform us at customerservices@penelopechilvers.com if you wish to return any item/s during this 14 day period, then you have a further 14 days to send the goods back. If you informed us and returned the entire order, we will refund the cost of the item/s plus any basic delivery charges that were made at the time of purchase. If you paid extra for express delivery, you will only be refunded the basic delivery charge.


Payment


Will be debited and cleared from your account upon receipt of your order and once the card details have been cleared to ensure the credit/debit card that is being used is yours, or that you have been specifically authorised by the owner of the credit/debit card to use it.  All credit/debit card holders are subject to validation checks and authorisation by the card issuer.  If the issuer of your payment card refuses to authorise payment to Penelope Chilvers, we will not be liable for any delay or non-delivery.  By accepting these terms and conditions you consent to such checks being made.  All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998. Payment for the Products and all applicable delivery charges is taken in advance.


General


Severability. If any part of these Terms are found to be unenforceable as a matter of law, all other parts of these Terms will not be affected and shall remain in force.  For the avoidance of doubt, should these Terms or any part of them be deemed void or voidable, this shall not affect the validity of any licence provided under these Terms and policies.

Reliance on these Terms.  We intend to rely on these written Terms and any document expressly referred to in them in relation to the subject matter of any contract between us.  We and you will be legally bound by these Terms.

Events or circumstances beyond our reasonable control.  If we are prevented or delayed from complying with our obligations under these Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events or circumstances beyond our reasonable control. In such circumstances including fire, flood and other acts of God, strikes, trade disputes, lock outs, restrictions of imports or exports, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, our inability or delay in performing our obligations will not be deemed to be in breach of contract.

References to ‘including’ and other similar expressions.  In these Terms, words that appear after the expression ‘include’, ‘including’, ‘other’, ‘for example’, ‘such as’ or ‘in particular’ (or any similar expression) will not limit the meaning of the words appearing before such expression. 

Assignment. You may not assign, sub-license or otherwise transfer any of your rights under these Terms. 

Waiver. If you breach these Terms and we choose to ignore your breach, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.

Exclusion of third party rights.  These Terms do not create any right enforceable by any person who is not a party to them (or any contract made under them), except that the provisions of these Terms may be enforced by any of our licensors subject to and in accordance with the Contracts (Rights of Third Parties) Act 1999.

Language.  These Terms may be presented to you in more than one language. However, the English language version of these Terms shall prevail.  The contract between us will be concluded in English.

Governing law and jurisdiction. Any disputes or claims between us arising out of or in connection with these Terms or any contract made under them (including non-contractual disputes or claims) are governed by and construed in accordance with the law of England and Wales.  Any disputes or claims arising shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this paragraph shall deprive consumers of the right to bring or defend proceedings in their home state nor of the protection afforded to them by the mandatory rules of law of the country in which they live. 


Changes To These Terms


We may make changes to these Terms at any time by sending you an email with the modified Terms or by posting a copy of them on the Site. Any changes will take effect 7 days after the date of our email or the date on which we post the modified terms on the Site, whichever is the earlier. If you continue to use the Site after that period has expired, it means that you accept any such changes.

Thank you for purchasing your Goodyear Welt Construction boots from Penelope Chilvers.

Penelope Chilvers distributes its products through authorized retailers and its online store at www.penelopechilvers.com.

Below are the warranty policy details specifically for Goodyear Welt Construction boots purchased from Penelope Chilvers or authorized retailers.

This warranty policy is valid as of the 14th of October 2024

I. Limited Warranty

Penelope Chilvers provides this warranty to consumers who purchased Goodyear Welt Construction boots (Product(s)) from Penelope Chilvers or one of its authorized retailers. Penelope Chilvers warrants all new Goodyear Welt Construction boots to be free from manufacturing or material defects (Defects) for the Warranty Period defined below. This warranty applies only against Defects discovered within the Warranty Period and extends only to the original purchaser of the Product. While Penelope Chilvers takes reasonable care to ensure that the Products meet their descriptions and specifications, it is your responsibility to ensure that the Products you purchase are designed for your intended use.

This warranty is valid only in the country where the Product was purchased, provided that Penelope Chilvers intended the Product to be sold in that country. Please refer to the list of authorized retailers. Depending on the country, specific warranties may apply under applicable legislation; to the extent that such warranties cannot be excluded or limited by law, nothing in this warranty policy shall exclude or limit these statutory provisions.

Warranty Period

The Warranty Period starts on the date of retail purchase of the Product by the original purchaser and lasts for a period of Two (2) years.

The Warranty Period will not be extended, renewed, or otherwise affected by subsequent resale, repair, or replacement of the Product. However, parts repaired or replacement Products issued during the Warranty Period will be warranted for the remainder of the original Warranty Period only, provided such replacement or repair has been performed by Penelope Chilvers or an authorized retailer. In countries with mandatory longer minimum Warranty Periods under applicable legislation, the Warranty Period stated herein shall be amended as necessary to comply with such laws.

II. Conditions and Restrictions

This Limited Warranty does not cover:

Normal wear and tear of the Product.

Defects caused by transportation (other than the initial delivery) or storage of the Product.

Defects or damage caused by improper use, storage, or maintenance.

Damages due to modifications of the Product.

Natural defects in materials or artisan construction techniques, such as variations in leather, which may develop over time.

Impact caused by sharp or hard objects, torsion, compression, falls, or other actions not under Penelope Chilvers’s reasonable control.

This Limited Warranty is not enforceable if:

The Product has been modified or repaired by any person or entity other than Penelope Chilvers or an authorized retailer.

The Product has been repaired with unauthorized spare parts.

The Product serial number has been removed, altered, or made illegible.

The claimant is not the original purchaser.

The claimant cannot provide proof of purchase.

III. Warranty Enforcement

Penelope Chilvers or its authorized retailer shall, at its sole discretion, either (a) repair the Product or (b) replace the Product at no charge. The appropriate remedy will be determined based on the price/value of the Product (without Defect), the significance of the Defect, and the inconvenience each remedy would place on the original purchaser. All repair or replacement will be carried out within a reasonable period.

For warranty claims, please submit the Product and proof of purchase to the nearest authorized retailer or, if purchased online, contact Customer Service at customerservices@penelopechilvers.com.

IV. Disclaimer and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE MANDATORY LAWS, THIS LIMITED WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED. PENELOPE CHILVERS SHALL NOT BE LIABLE FOR ECONOMIC, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL LOSSES OR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF ANTICIPATED BENEFITS, LOSS OF USE, LOSS OF REVENUE, COST OF SUBSTITUTE EQUIPMENT, CLAIMS OF THIRD PARTIES, OR DAMAGE TO PROPERTY RESULTING FROM THE PURCHASE OR USE OF THE PRODUCT.

In relation to purchases made in the United Kingdom, this warranty shall be governed by, and construed in accordance with, English law. All parties irrevocably submit to the exclusive jurisdiction of the English courts to settle any dispute arising under or in connection with this warranty. To the extent that English law applies, nothing in this warranty shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability that may not be lawfully excluded or limited.

Penelope Chilvers reserves the right to withdraw this warranty or amend its terms and conditions without notice. This does not affect your statutory rights.
